Terms of Use
These terms are the agreement between you and Stnding for the use of stnding.com. By creating an account or using the site you accept them. If you do not accept them, do not use the site.
1. Who you are contracting with
Stnding is operated by an individual trading as Stnding, established in the United Kingdom (“we”, “us”). Our full legal name and postal address for service are available on request from team@stnding.com and will be published on this page.
2. What the service does
Stnding reads data from brokerage accounts you connect, computes performance figures from it, and publishes a record under a username you choose. It also lets you follow other records, write notes against days of your own record, and browse published records.
Stnding does not hold client money or assets, does not place orders, does not manage anyone’s portfolio, and is not authorised or regulated by the Financial Conduct Authority or any other financial regulator. It is a publishing tool.
The service is free to use today. If we introduce paid features we will say so before you are charged, and the terms of any paid plan will be presented at that point.
3. Who may use it
You must be 18 or over and able to enter a binding contract. You must not be subject to sanctions, or resident in a country subject to comprehensive sanctions, that would make it unlawful for us to provide the service to you. If you connect a brokerage account you must be entitled to authorise that connection and to publish what it contains.
You are responsible for complying with the law that applies to you, including any rules of your employer, your regulator or your brokerage about disclosing your positions or trading activity. Some people are not permitted to publish their trading. Check before you publish.
4. Your account
You are responsible for your password and for what happens under your account. Tell us at team@stnding.com if you think it has been compromised. We may reclaim a username that impersonates someone, infringes a trade mark, or is reserved for the operation of the site.
5. Brokerage connections
Brokerage linking is provided by SnapTrade, a service of Passiv Inc. Connecting an account means you also accept SnapTrade’s end user terms and privacy policy. Your brokerage credentials are entered with SnapTrade or your brokerage and are never seen by Stnding.
We ask for read-only access. We cannot trade, transfer or withdraw, and we do not ask for the ability to. You can revoke the connection at any time through your brokerage, through SnapTrade, or by disconnecting in the product.
Your brokerage relationship is separate from this one. We are not responsible for a brokerage’s or SnapTrade’s availability, accuracy or conduct, and an outage or error at either can leave a record delayed, incomplete or wrong.
6. Publishing a record
When you publish a record you are the publisher of it. You decide to make it public, you choose what the delay is, and you are responsible for what it says and for what you say about it anywhere else.
You agree that you will not:
- Use your record, your notes, or your profile to give investment advice or to manage anyone else’s money, or offer to do either
- Invite or induce anyone to invest, whether in a fund, a managed account, a signal service or anything else, unless you are authorised to make that kind of communication or an exemption applies to you
- Present a record as audited, as verified by an accountant, or as carrying any approval it does not have
- Present a delayed, partial, demonstration or discreet record as something it is not, or publish a record of an account that is not yours
- Guarantee a return, or imply that past results will repeat
In the United Kingdom, inviting or inducing someone to engage in investment activity is restricted by section 21 of the Financial Services and Markets Act 2000. Other countries restrict the same conduct in their own way. Whether a communication of yours is caught is your responsibility to determine, not ours.
7. The figures we compute
The performance figures on a record are computed by Stnding from the data a brokerage sends. They are estimates produced by software. They are not audited, not certified, and not a statement of account from your brokerage. The method, and what the figures leave out, is described in About.
Brokerages correct and resend data, and we correct our own methods. A figure can therefore change after it is first published. We do not warrant that any figure is accurate, complete or current, and neither you nor anyone reading your record should treat one as a statement of fact about your account. Check your record against your brokerage statements. If a figure looks wrong, tell us.
8. The delay and Discreet Mode
The publication delay and Discreet Mode are applied on our servers before a page is sent, and we build them to hold. They are product features, not a security guarantee, and they protect nothing once information has been published. A visitor who could read your record yesterday may have kept a copy, and we cannot retrieve it. Shortening a delay publishes days that were previously private and cannot be undone for anyone who has already read them.
9. Reading someone else's record
A record published here is that person’s statement about their own account, not ours. We do not verify who they are, whether they are permitted to publish it, or whether what they say about it elsewhere is true. We do not endorse anyone whose record appears on the site, including anyone shown in Explore, and the order records appear in is not a recommendation.
Any decision you take after reading a record is yours alone. Do not send anyone money because of what you read here.
10. Acceptable use
You must not:
- Try to reach another user’s account, or any data the site has not published to you
- Probe, scan or test the security of the service except as section 12 allows
- Scrape or copy the site at a scale that burdens it, or use automated means to collect user data
- Upload anything malicious, or interfere with how the service runs
- Post anything unlawful, deceptive, infringing, or that impersonates another person or firm
- Use the service for market manipulation, fraud or sanctions evasion
11. Your content and reporting problems
You keep whatever rights you have in what you submit, including your display name, bio and notes. You give us permission to store, display and distribute that material as part of running the service, including on public pages and in link previews. That permission ends when you delete the material, except for copies already made by others and for backups until they expire.
If something on the site infringes your rights, impersonates you, or should not be there, write to team@stnding.com with the address of the page and what is wrong with it. We will look at every report and remove or restrict what we conclude should not be published. We can remove content or suspend an account at our discretion, and we do not undertake to monitor everything published.
12. Reporting a vulnerability
Testing the security of the service is permitted only as described on the Security page, and only within the limits set out there. Report what you find to team@stnding.com.
13. Availability and changes
We do not promise the service will be available or uninterrupted. We may change, suspend or withdraw any part of it, and we may change these terms. If a change to these terms is significant we will say so on this page and, where we can, tell account holders. Continuing to use the service after a change means you accept it.
14. No advice and no duty to you
Nothing on Stnding, from us or from any other user, is investment, tax, legal or accounting advice, and nothing here is an offer or invitation to buy or sell anything. We are not your adviser, we owe you no fiduciary duty, and no relationship of trust arises from your use of the site. See the Risk Disclaimer.
15. What we do not promise
The service is provided as it is and as it is available. To the extent the law allows, we exclude all implied terms, warranties and conditions, including any that the service will be fit for a particular purpose, uninterrupted, secure, or free of error, and any that the data or figures it produces are accurate, complete or current.
16. Our liability to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you deal with us as a consumer, your statutory rights are unaffected by anything in these terms.
Subject to that, and to the extent the law allows, we are not liable for any trading or investment loss, lost profit, lost opportunity, lost data, loss of goodwill or reputational harm, or for any indirect or consequential loss, however it arises, whether or not we were told it was possible. In particular we are not liable for a decision you or anyone else takes after reading a record, or for any loss arising from a figure that turns out to be wrong, from data a brokerage or SnapTrade supplied, delayed or failed to supply, or from information becoming public through your own publication settings.
Subject to the first paragraph of this section, our total liability to you for everything connected with the service will not exceed the greater of one hundred pounds sterling and the total amount you have paid us in the twelve months before the claim arose.
17. Your liability to us
If you use the service for the purposes of a business, you will indemnify us against any claim, loss or cost we incur because of your use of the service, what you have published through it, or your breach of these terms. This section does not apply to you if you use the service as a consumer.
18. Ending it
You can stop using the service whenever you like and delete your account in Settings, which removes your record from the site. We may suspend or close an account that breaches these terms, or where we reasonably need to in order to protect the service or other people. Sections 6, 7, 9, 14, 15, 16, 17 and 19 survive the end of this agreement.
19. Law and disputes
These terms and any dispute arising out of them or the service are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of the law of the country you live in, and you may be able to bring proceedings there.
Please write to team@stnding.com first. Most things are quicker to sort out that way.
20. General
These terms, together with the Privacy Policy and the Risk Disclaimer, are the whole agreement between us about the service. If any part of them is found unenforceable, the rest continues to apply. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your rights under these terms; we may transfer ours if the service changes hands, and your rights will not be reduced by that.
